Contest Rules

Overview:

Cherry Apparel a California online clothing brand, is giving away one (1) entire catalog as of June 23 2023.

To be eligible the Giveaway entrant must reside in the United States, must be 18 years of age or older. 

The Giveaway entry time period is between 9AM PDT on June 23, 2023 and 9AM PDT, July 13, 2023. During this time Company will post Giveaway details on the CONTEST RULES page (https://www.cherrysapparel/pages/contest-rules). This page will update on June 30, 2023 with a winner! and to be first to know about new giveaways going our Cherry Mailing List. By making an entry each entrant confirms that each entrant meets all eligibility requirements and has read these Official Rules, and confirms that by entering this Giveaway and the acceptance of the prize each Winner agrees to the use of their personal rights of publicity as set out in the below Consent and Release by Company and its affiliates relating to this Giveaway.

Release of Instagram

By entrant’s entry into this Giveaway each entrant acknowledges that this Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram, and each entrant releases Instagram from any liability arising out of the Giveaway.

California Consumer Privacy Act (CCPA) Compliance

The compliance by Instagram with the obligations imposed by the CCPA on Instagram are not part of the Giveaway and can be found at Instagram’s notification page at https://help.instagram.com/2482657248648591. For questions about this, contact https://www.facebook.com/help/contact/784491318687824.

Termination of Giveaway and Entries: Company reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in Company’s sole discretion) a virus, bug, non-authorized human intervention, fraud or other cause beyond Company’s control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. Company reserves the right at its sole discretion to disqualify any entry which is the result of tampering or attempt to tamper with the entry process or the operation of the Giveaway or associated websites. Company has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Company reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering each entrant agrees to release and hold Company and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors harmless from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) participation in the Giveaway and/or acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process and the prize process; and (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries.

Disputes: Should any entrant have any dispute/claim regarding this Giveaway, each entrant agrees to first address it to Company at support@cherrysapparel.com. Should the parties be unable to resolve it within 3 months, then entrant and Company shall submit such claim/dispute only before a JAMS arbitrator in Los Angeles County brought for final resolution, and shall be governed by the laws of the State of California, as applicable.  The parties agree that each shall waive all rights to a trial before a judge or jury in any other tribunal or court on the dispute/claim.  In such a proceeding all parties agree to waive all claims to punitive, incidental, or consequential damages.  All parties shall bear their own costs and fees incurred in this proceeding, and in any proceeding incidental to this proceeding (such as a request for a preliminary injunction before a court.)  Each entrant also agrees that by participating in this Giveaway the entrant will not act as a class representative in a class action,  or participate in any class action relating to this Giveaway.

Rights of Publicity Release

Each winner hereby agrees by his/her/they/them entry to a full release of all of his/her/they/them personal rights of publicity in his/her/they/them name and photograph and Instagram handle in connection with the Giveaway. The contract terms for this are as follows.
